How do I recover my deductible from the at-fault driver?

You usually don't have to pay your deductible if you aren't at fault for the accident. Typically, your insurance provider will pursue the subrogation process for you and recover the deductible from the at-fault driver on your behalf. Your insurance company will inform you when the subrogation process begins and will recover your deductible from the at-fault driver and then refund it back to you in the event that you paid upfront for damages.
